Section 1-1215. ASSIGNMENT OF BOARD MEMBERS TO HEARING PANELS

    1215.1Board members shall sit on hearing panels in such order and at such times as the Chairperson of the Board directs.

     

    1215.2In determining the composition of a hearing Panel, the Chairperson shall:

     

    (a) Comply with the requirements of Section 908(c) of the Act;

     

    (b) Assign the Board member designated by the Director of the Department of Behavioral Health, or the public member who qualifies as mental health professional, to any hearing panel at which an issue concerning the mental health of the appellant will be adjudicated; and

     

    (c) Make hearing assignments in a manner that equitably divides the workload among the Board members.

     

    1215.3In the sole discretion of the Chairperson, a hearing may be assigned to the full Board.

     

    1215.4Any decision of a hearing Panel shall be the final decision of the Board with no right of any party to request consideration by the full Board; provided, a party may request  reconsideration, rehearing, or re-argument before the Panel pursuant to Section 1222.
