Section 1-1514. TRANSFER OF RECORDS FROM THE CUSTODY OF ONE AGENCY TO ANOTHER

    1514.1No records shall be transferred from the custody of one agency to another without the prior written approval of the Administrator.

     

    1514.2The head of any agency may request the transfer of records to or from the agency. Approval shall be requested by a letter addressed to the Administrator through the Archivist.

     

    1514.3The agency request shall include the following:

     

    (a)a detailed description of the records to be transferred;

     

    (b)a statement of the current and proposed physical and organizational location of the records;

     

    (c)information as to why the proposed transfer is requested; and

     

    (d)a justification of the transfer of records that are more than five (5) years old.

     

    1514.4The Administrator shall notify the agency in writing of his or her decision.

     

    1514.5Prior written approval of the Administrator shall not be required under the following conditions:

     

    (a)Records are transferred to an approved records storage facility or to the Archives;

     

    (b)Records are loaned for official use; or

     

    (c)The transfer of records or functions or both is required by statute, Reorganization Plan, Mayor’s Order, or other legal directive.
