Section 1-2941. RENTAL HOUSING CASES - INTEREST ON SECURITY DEPOSITS

    2941.1In any case in which a tenant claims entitlement to interest on a security deposit under D.C. Official Code § 42-3502.17(b), the tenant must produce evidence of the amount of the security deposit that was given to the housing provider, the date on which it was given, and amount of  interest, if any, paid to the tenant. 

     

    2941.2If the tenant does so, then the housing provider must produce evidence of the amount of interest that was earned on the security deposit.

     

    2941.3If the housing provider fails to produce evidence of the amount of interest that was earned, or the security deposit was not held in an interest bearing account, the Administrative Law Judge shall compute interest by applying the Superior Court of the District of Columbia judgment rate prevailing on January 1st and on July 1st for each six (6)-month period (or part thereof) of the tenancy.
