Section 10-B2116. UNSOLICITED OFFERS FOR DEVELOPMENT

2116.1All unsolicited offers for redevelopment sites sent or referred to either the Agency or the Department shall be forwarded to the Director of the Department for appropriate action.
2116.2The Director or an assigned member of the Department shall immediately acknowledge the request and advise the offeror that the Department will do the following:
(a)Recommend to the Board that it authorize negotiations;
(b)Recommend to the Board that it deny the request for negotiations; or
(c)Require additional information before a recommendation can be made to the Board.
2116.3When the Department decides to recommend an action under §2116.2 to the Board, the recommendation shall be based upon a finding of the existence of one (1) or more of the conditions set forth in §2102.4.
2116.4The Department shall notify the offeror in writing of the date, time, and place that the request for negotiation is to be considered by the Board.
2116.5The notice shall also inform the offeror that the offeror may request the Board in writing to make an oral presentation of the request. The Board may determine whether to honor the request.
2116.6The Board, by resolution, shall either reject or conditionally accept the offer of negotiation. The resolution shall stipulate a time by which the negotiations are to be completed and may require periodic reports on the status of the negotiations.
2116.7If the offer is rejected, the Department shall forward a copy of the Board action to the offeror.
2116.8If the offer is conditionally accepted, the Board shall instruct the staff to submit the proposal to the Council for a thirty (30) day review and comment period and simultaneously to begin negotiations with the offeror.
