Section 10-B2718. VARIANCES PROCEDURE

    2718.1Variations from the requirements of this chapter may be made, in the discretion of the Mayor, in cases of practical difficulty or unnecessary hardship when not in conflict with any mandatory law or other regulations of the District of Columbia.

     

    2718.2The owner of the property for which variation is requested shall submit his or her request, in writing, through the Surveyor to the Mayor.

     

    2718.3The request shall be in ink or typewritten, and signed in ink by the owner or owners, and the request shall include the following:

     

    (a)A clear statement of the variation sought and reason for so requesting;

     

    (b)A map or sketch sufficiently clear to convey the nature of the variance requested; and

     

    (c)The report of the Surveyor and such other reports from the District officials as may, in the Surveyor 's judgment, be necessary.

     

    2718.4Upon request for variance, a notice shall be published in one (1) daily newspaper once a week for two (2) consecutive weeks. The notice shall provide that any person opposing the variance may file with the Surveyor of the District of Columbia within thirty (30) days after the last notice, and that statements of opposition will be forwarded to the Mayor or his or her designated agent, together with recommendations by the Surveyor.
