Section 11-X309. PLANNED UNIT DEVELOPMENT APPROVALS

  • 308.1 The Zoning Commission’s first-stage approval shall set forth the appropriate zoning classification to apply to the project, and shall state in detail the elements, guidelines, and conditions that shall be followed by the applicant in the second-stage application.

    308.2 If the Zoning Commission finds the application to be in accordance with the intent and purpose of the Zoning Regulations, the PUD process, and the first-stage approval, the Zoning Commission shall grant approval to the second-stage application, including any guidelines, conditions, and standards that are necessary to carry out the Zoning Commission's decision. 

    308.3 At the point at which a decision is made on a consolidated review application, the Zoning Commission may also determine that a second review is required, and rather than approving the application in a consolidated review, grant first-stage approval only and require that the applicant file additional plans for second-stage approval.

    308.4 Provisions conserving the duration and implementation of an approved first- or second-stage PUD appear in Subtitle Z § 702.

    308.5 Provisions setting forth the procedure and standards for requesting an extension of the Zoning Commission’s first- or second-stage approvals are set forth in Subtitle Z § 706.

    308.6 The procedures for modifying or correcting an order approving a PUD are set forth in Subtitle Z.
