Chapter 14-40. RENTAL ACCOMMODATIONS AND CONVERSION DIVISION (RACD) HEARINGS |
Section 14-4010. SUBPOENAS

4010.1Any party may request the Rent Administrator to issue a subpoena requiring the attendance and testimony of witnesses or the production of documents or other evidence in accordance with § 204 of the Act.
4010.2Each request of a subpoena shall be submitted in writing at least five (5) days prior to the hearing, and shall specify with particularity the books, papers, or person whose testimony is desired.
4010.3The Rent Administrator shall rule promptly on each request for a subpoena.
4010.4All subpoenas shall be served on the witnesses or parties prior to the hearing in the manner, and by any person authorized, in accordance with the Civil Rules of the Superior Court of the District of Columbia.
4010.5Any person to whom a subpoena is directed may file a motion to quash or limit the subpoena, setting forth the reasons why the subpoena should not be complied with or why it should be limited in scope.
4010.6Motions to quash or limit subpoenas shall be filed with the Rent Administrator prior to the hearing, or with the hearing examiner as a preliminary matter during the hearing.
