Section 14-6317. NOTICE TO VACATE PREMISES

6317.1If the complaint relates to the termination of a dwelling lease through the service of a Notice to Vacate upon the complainant, and the hearing officer’s determination upholds the action to terminate the tenancy, DCHA shall take no further action to evict the resident until it has served upon the resident a Notice to Vacate; provided, that the notice shall not be subject to the filing of a complaint under the grievance procedure.
6317.2A Notice to Vacate shall not be issued prior to the date the Hearing Officer’s final decision under § 6313.1 is delivered or mailed to the complainant.
6317.3Whenever a Notice to Vacate is given to the complainant, he or she shall be informed in writing of the following:
(a)If he or she fails to vacate the premises within the appropriate period, further appropriate legal actions shall be taken against him or her; and
(b)If suit is brought against him or her, the resident may be required to pay court costs and attorney fees incurred.
