Section 15-615. DECISIONS AND APPEALS

615.1The Hearing Officer shall render a decision within twenty (20) days after the close of the record.
615.2Any party may appeal the Hearing Officer's decision to the Commission within ten (10) business days of personal service or twelve (12) business days of service by mail of the decision.
615.3Pursuant to D.C. Code Ann. § 43-904 (b), an appeal to the Commission shall stay the Hearing Officer's decision.
615.4The appeal shall be signed by the party, identify the decision appealed, and specify the grounds upon which the appeal is based.
615.5The Commission Secretary shall serve, personally or by first class mail, a copy of the appeal on the other party or parties on the day the appeal is filed.
615.6The other party or parties shall file any response within ten (10) business days of personal service or seven (7) business days of service by mail.
615.7Within seven (7) business days of the filing of an appeal, the Commission Secretary shall prepare the record for review by the Commission.
615.8The Commission shall review and rule on the appeal no later than thirty (30) days after the record is submitted.
615.9On appeal, the Commission shall:
(a)Affirm the decision of the Hearing Officer;
(b)Reverse or modify the decision; or
(c)Remand the matter to the Hearing Officer for further proceedings.
615.10The decision of the Hearing Officer shall be final absent an appeal to the Commission.
615.11Once a decision to terminate or alter service becomes final, the PSP shall comply with that order within three (3) business days.
615.12Reconsideration or appeal of a final Commission decision shall be made pursuant to D.C. Code §§ 43-904 and 43-905.
