Section 16-1513. REQUESTS FOR PRODUCTION OF DOCUMENTS AND THINGS AND ENTRY UPON LAND FOR INSPECTION AND OTHER PURPOSES

  • 1513.1Any party may serve on any other party a request to produce and permit the party making the request, or someone acting on his or her behalf, the following:

     

    (a)To inspect and copy any designated documents;

     

    (b)To inspect and copy, test or sample any tangible things which constitute or contain matters relevant to the action and which are in the possession, custody or control of the party upon whom the request is served; or

     

    (c)To enter upon the party the land or other property in the possession or control of the party upon whom the request is served for the purpose of inspecting, and measuring, surveying, photographing, testing, or sampling the property or any designated object or operation thereon within the scope of the action.

     

    1513.2The request shall describe the items to be inspected, either by individual items or by category.

     

    1513.3The request shall specify a reasonable time, place and manner of making the inspection and performing the related acts. For purposes of this section, "Reasonable time" shall not be less than twenty-one (21) days from the service of the request.

     

    1513.4The party upon whom the request is served shall serve a written response within twenty (20) days after service of the request.

     

    1513.5The response shall state, with respect to each item or category, that the inspection and related activity shall be permitted as requested, unless the request is objected to, in which case the reason for the objection shall be stated.

     

    1513.6The party requesting to copy any discoverable matter shall bear the cost for reproduction and related costs.
