Section 17-2909. RIGHT OF ENTRY AND INSPECTION

    2909.1The Director has the right, after presenting credentials, to enter, with or without prior notice the premises of the following:

     

    (a)An animal facility;

     

    (b)An animal facility for which an application under this chapter is pending; and

     

    (c)An unlicensed premises that the Director has reason to believe is being operated in violation of the Act or this chapter.

     

    2909.2A licensee or applicant shall give the Director access to records, policies and procedures, contracts, and any other information that the Director deems necessary to determine the animal facility's compliance with the Act, this chapter, or other law.

     

    2909.3The Director shall submit a written report to licensee within fifteen (15) days after the conclusion of the inspection.

     

    2909.4The Director may require the licensee to respond to the written report with a written plan of correction within ten (10) days after the receipt of the report.

     

    2909.5The Director shall require the licensee to correct the deficiencies within the time period required by the Director or propose an action to revoke, suspend, refuse to renew, or deny the license under §2931.

     

    2909.6The Director shall not enter and inspect an unlicensed animal facility without the permission of the applicant, licensee, owner, or person in charge unless a search warrant is first obtained from the Superior Court of the District of Columbia pursuant to D.C. Code §11-941 (1981).

     

    2909.7The Director may refer to the appropriate agencies in a case involving an animal facility that the Director reasonably believes is operating in violation of the Act or other applicable laws or regulations.
