Section 18-2411. RESIDENTIAL PERMIT PARKING

2411.1Except as provided in §§ 2411.2, 2412, 2414, and 2424, parking a motor vehicle on a residential permit parking street within the same zone shall be restricted, as follows:
(a)To a consecutive two (2) hour period between 7:00 a.m. and 9:00 p.m. Monday through Saturday within the boundaries of Historic Georgetown, and in Ward 5 in the area of 30th Street, N.E., between South Dakota Avenue and Central Avenue, N.E., and Yost Place, N.E., between Vista Street and Bladensburg Road, N.E., between 7 a.m. and midnight; and between 7 a.m. and 8:30 p.m., in all other areas of the District, unless the motor vehicle displays a valid residential permit parking sticker for the designated areas. The residents of specific blocks may petition to change the times for their residential parking permit designation pursuant to § 2411.14.
(b)The provisions § 2411.1(a) shall apply only to the extent that funds are available to cover the additional costs of personnel and equipment needed to enforce these restrictions.
(c)Notwithstanding § 2411.1(a), motor vehicles shall have a valid residential permit parking sticker to park at all times in the following locations:
(d)If, after two (2) hours, a vehicle without the necessary residential permit parking zone sticker has been parked in the same zone, then a notice of infraction specified in section 2601.1 may be issued pursuant to chapter 30, citing a violation of section 2411.1(a).
(e)A separate notice of infraction specified in section 2601.1, also citing a violation of section 2411.1(a), may be issued pursuant to chapter 30 for each additional two (2) hour period the vehicle has been parked in the same zone.
2411.2[REPEALED]
2411.3Each Ward of the District shall constitute a separate residential permit parking zone; provided, that parking zone in census tract 79.03, (starting at the corner of Nineteenth Street, N.E., and Benning Road, N.E., east along said Benning Road, N.E., to Oklahoma Avenue, N.E.; thence in a southerly direction along said Oklahoma Avenue, N.E., to C Street, N.E.; thence west along said C Street, N.E., to Nineteenth Street, N.E.; thence north along said Nineteenth Street, N.E., to the point of beginning) shall be zoned as Ward 6
2411.4Notwithstanding the notice requirements in §§ 6 and 10 of the District of Columbia Administrative Procedure Act, approved October 21, 1968 (82 Stat 1204; D.C. Code § 1-1506 et seq. (1981), within each residential permit parking zone, the Director may designate for residential permit parking any block of a street which meets the following criteria:
(a)It is abutted primarily by residential, recreational, or parkland uses. If a block has residential permit parking, in cases where a building contains both residential land uses, the Director shall determine whether it is appropriate for some or all of the abutting curb space to be designated for residential permit parking;
(b)It is impacted by commuter vehicles between 7:00 a.m. and 6:30 p.m., on weekdays, or it is not impacted by commuting vehicles; but it is surrounded by blocks which are designated as residential permit parking blocks;
(c)A petition has been submitted to the Director supporting its designation as a residential permit parking street. A petition is not necessary, and the Director may initiate a block for inclusion in the program where:
(i)There are no residences with addresses on a block which abuts the side or rear of residences included in the program, or on a block which abuts a park or recreational facility;
(ii)The block to be designated is within 5 blocks of a commercial district or any other private or public facility that accommodates 500 people or more, such as a theatre, concert hall, convention center, stadium, nightclub, university, or any other major traffic generator; or
(iii)There is less than twenty percent of free curb space available for resident parking.
(d)It meets the objective criteria established by the Director pursuant to § 2412.
2411.5The petition referred to in § 2411.4(c) shall be signed by at least one (1) adult resident of a majority of the households on the block.
2411.6In cases where a petition represents less than a majority of the individual households, but where circumstances suggest that the majority of the residents support residential permit parking, the Director may, at his or her discretion, initiate a vote on whether or not the block shall be part of the residential parking program.
2411.7Ballots shall be distributed to each household on the block, and the majority of the ballots returned within fifteen (15) days shall be regarded as indicating the will of the residents of the blocks.
2411.8The Director may withdraw the designation of any block for residential permit parking based upon the receipt of a petition signed by a majority of the households on the block.
2411.9The Director may withdraw the designation of a block for residential permit parking from a block on which there are no residences with addresses only after giving thirty (30) day written notice to the affected Advisory Neighborhood Commission.
2411.10The Director may remove signs from a part of a block designated for residential permit parking only after giving thirty (30) day written notice to the affected Advisory Neighborhood Commission.
2411.11The Director shall, on a quarterly basis, provide the Council with a list, by Ward, of each residential area included or withdrawn from the residential permit parking program within the prior three (3) months.
2411.12When the Director provides the list described in § 2411.11, the Director shall publish the list in the D.C. Register.
2411.13While a vehicle for which a residential parking permit has been issued is parked in the residential permit parking zone, the permit shall be affixed by its own adhesive to the lower left (driver’s) side of the windshield so that it is clearly visible through the windshield of the vehicle; Provided, that in the case of a motorcycle, motor-driven cycle, or trailer, the permit shall be affixed to a mounting tab which shall be bolted to either corner of the identification tag. Expired permits shall not be left visible on a vehicle after affixing a new permit.
2411.14The Director is authorized to modify the provisions of this section, including those provisions setting forth the times of, days of, criteria for, and exceptions to residential permit parking restrictions, as necessary, through rulemaking.
2411.15Notwithstanding the notice requirements in §§ 6 and 10 of the District of Columbia Administrative Procedure Act, approved October 21, 1968 (82 Stat 1204; D.C. Official Code § 1-1506 et seq.), within each residential permit parking zone, the Director may re-designate, at his or her discretion, the times for residential permit parking of any specific block which meets one (1) of the following criteria:
(a)The block meets the objective criteria established by the Director pursuant to § 2412; or
(b)A petition has been submitted to the Director by the residents of the block, supporting the change of time for residential permit parking restrictions for their specific block.
2411.16The petition referred to in § 2411.14(b) shall be signed by at least one (1) adult resident of a majority of the households on that block.
2411.17In cases where a petition, submitted pursuant to § 2411.14(b), represents less than a majority of the individual households, but where circumstances suggest that a majority of the residents support the new time designation, the Director may, at his or her discretion, initiate a vote on whether or not the block shall be re-designated.
2411.18Ballots for votes, pursuant to § 2411.17, shall be distributed to each household in the area, and the majority of the ballots returned within fifteen (15) days shall be regarded as indicating the will of the residents of the block.
2411.19Between the hours of 9:00 p.m. and 7:30 a.m., vehicles displaying a valid residential parking permit may park, within a designated residential permit parking zone, in the following manner:
(a)[REPEALED]
(b)In loading zones, except loading zones used by hotels; and
(c)In entrances, except hospital entrances.
2411.20Vehicles displaying a valid residential parking permit may park on any residential permit parking street within one block of any street that serves as a new ward boundary under the Ward Redistricting Amendment Act of 2001, effective October 2, 1991 (D.C. Law 14-27; 48 DCR 6380), provided that the residential parking permit is valid for a ward on either side of the new ward boundary street.

2411.21Vehicles displaying a valid residential parking permit may park at all times, within a designated residential permit parking zone, twenty-five (25) feet or more from the intersection. The Director of the District Department of Transportation shall have the discretion to exempt intersections from the parking restriction moratorium established by this section that the Director determines would be inappropriate and unsafe with such parking.
2411.22Parking is permitted within a legal curved driveway located in the front of any one-family detached dwelling at any time.
2411.23The following blocks shall be added to the Residential Parking Program pursuant to 2411.4 (c): [Repeated subsection added by DDOT Rulemaking, May 7, 2004, 52 DCR 4774]

2411.24As provided in § 2424.6, within the Ballpark Performance Parking Pilot Zone, parking a motor vehicle on a residential permit parking street shall be restricted, as follows:
(a) All residential streets east of South Capitol Street, S.E. to a consecutive two (2) hour period between 7:00 a.m. and 9:30 p.m. Monday through Saturday, unless the motor vehicle displays a valid Zone 6 residential permit parking sticker or visitor permit for the designated area;
(b) All residential streets west of South Capitol Street, S.E. to a consecutive two (2) hour period between 7:00 a.m. and 12:00 a.m. (midnight) Monday through Sunday, unless the motor vehicle displays a valid Zone 6 residential permit parking sticker or visitor permit for the designated area; and
(c) On all streets in the Ballpark Zone on the opposite side of the street, as designated 7:00 a.m. to 9:30 p.m. or 7:00 a.m. to 12:00 a.m. (midnight), no parking may occur unless the motor vehicle displays a valid Zone 6 residential permit parking sticker or visitor parking permit for the designated area.
2411.25An Enhanced Residential Permit Parking (ERPP) program shall be established within the boundaries of Ward 1:
(a) Each Ward 1 Advisory Neighborhood Commission (ANC) may implement an ERPP program within the ANC’s respective boundaries. The ERPP program shall include the following elements:
(1) One side of each residential block, or fifty percent (50%) of the parking spaces within the ANC boundaries, shall be reserved for Zone 1 Resident Only Parking; the opposite side of the residential block shall be designated as described in § 2411.1;
(2) A motor vehicle without a valid Zone 1 parking sticker shall not park on any portion of a street in Ward 1 that has been reserved for Zone 1 Resident Only Parking under the process established in this regulation;
(3) Any resident owning a vehicle registered at an address within the ERPP program area shall be eligible to apply for residential permit parking decals as provided by the Department of Motor Vehicles; and
(4) [REPEALED].
(b) Each Ward 1 ANC may, by resolution voted upon in accordance with the law governing ANCs, choose not to participate in the ERPP program. Absent such a resolution, all of the provisions of § 2411.25(a) shall apply to each residential block of the Ward 1 ANC unless prohibited by § 2411.25(c) or § 2411.25(d);
(c) Any blocks within a streetscape construction project impact zone in Ward 1 shall be excluded from the ERPP program until the Director of the District Department of Transportation declares that all major construction associated with the streetscape construction project impact zone is complete; and
(d)For purposes of this section, the phrase “streetscape construction project impact zone” means an area designated by the District Department of Transportation where, due to the nature and duration of a streetscape project (that is, a roadway construction project on a commercial street), a local or small business as defined in D.C. Official Code §§ 2-218.31 and 2-218.32 (2011 Repl.) may experience demonstrated losses during the construction period.
