Section 19-1507. SEARCH AND INSPECTION

    1507.1A conservation officer may conduct a search and inspection in the following instances:

     

    (a)The officer reasonably believes that a person either is or recently has been fishing;

     

    (b)The officer has probable cause to believe that the person has violated a provision of this chapter except as is provided in § 1507.2; and

     

    (c)When it is either not possible or not practical to obtain a warrant.

     

    1507.2In the absence of probable cause, an officer may conduct a search or inspection only to prevent the removal, alteration, or destruction of potential evidence of a violation of this chapter.

     

    1507.3Before beginning a search or inspection of a person, the officer shall state his or her purpose and inform the person that this chapter authorizes the search or inspection and requires the person to cooperate with the officer.
