Section 22-B4301. REGULAR AND EXPEDITED REVIEWS

4301.1SHPDA shall review each CON application by either a regular or an expedited process.
4301.2Except as provided in Subsection 4301.3, the expedited review process shall be used for each application that proposes major medical equipment or a new institutional health service for which there is an explicit finding of need in the HSP.
4301.3SHPDA shall not conduct an expedited review for an otherwise qualified project related to a service for which the HSP states there is an excess of capacity or that has not been included in the HSP.
4301.4SHPDA shall review an application through the regular review process at the request of an applicant even though the application qualifies for expedited review.
4301.5The Director shall render a written decision regarding a request for expedited review. A person may request reconsideration of the decision in writing upon providing good cause. A request for reconsideration shall not be referred to the SHCC.
4301.6The results of an expedited review shall be reported to the SHCC at the next regularly scheduled SHCC meeting.
4301.7SHPDA shall use the same criteria and standards that apply to projects reviewed by the regular process for an application that will receive expedited review, and designation for expedited review shall in no way imply automatic approval of the application by SHPDA.
4301.8The expedited review process differs from the regular review process as follows:
(a)An application reviewed through the expedited process shall not be referred to the SHCC for review and comment before the Director approves or denies an application; and
(b)An expedited review shall be completed within thirty (30) days after receipt of a completed application.
