Section 22-B6705. EMERGENCIES, IMPOUNDMENTS AND STOP ORDERS

    6705.1Whenever the Director finds that an emergency exists requiring immediate action to protect the public health and safety, the Director, may, without notice or hearing, issue an order stating the existence of the emergency, and requiring that action be taken as necessary to meet the emergency.

     

    6705.2In the event of an emergency constituting a hazard to the health of employees of the public or others, the Director may impound or order the impounding of sources of ionizing radiation in the possession of any person who is not equipped to observe, or fails to observe, the radiation provisions of this title.

     

    6705.3If all or part of any machine, device, or equipment is in a dangerous condition, or if it is not properly safeguarded, notice of the situation shall be given by the Director to any individual owning, operating, or possessing the machine, device, or equipment.

     

    6705.4Upon notice as required by §6705.3, and until the notice is withdrawn by the Director, use of the machine, device, or equipment shall be forbidden. The Director may withdraw the notice if he or she is satisfied that the machine, device or equipment has been made safe, or that proper safeguards have been instituted for operation, or for other reasons found pursuant to a hearing as provided for in §6709 of this chapter.
