Section 22-B9510. COST OR PRICING DATA

 

9510.1Bidders/offerors maybe required to submit and certify cost or pricing data before award of contract.

 

9510.2Certification and submission of actual cost or pricing data shall not be required when it is determined that prices are as follows:

 

(a)Based on adequate price competition;

 

(b)Based on established catalog or market prices of commercial items sold in substantial quantities to the general public; or

 

(c)Set by law or regulation.

 

9510.3Price competition exists if two (2) or more responsible offerors make a responsive offer to a solicitation issued by the Hospital, and they compete independently for a contract to be awarded.

 

9510.4When cost or pricing data are required, each offeror submits a certificate that states that to the best of the contractor’s knowledge and belief, the cost and/or pricing data are accurate, complete and current as of a determined specified date.
