Section 22-B9512. ETHICS IN PUBLIC CONTRACTING

 

9512.1To achieve the purpose of this section, it is essential that all persons doing business with the Hospital observe the ethical standards prescribed herein. The CO shall make available and disseminate to every person doing business with the Hospital, and to every Hospital managerial employee with procurement responsibilities, the requirements for this section.

 

9512.2It shall be the policy of the Hospital to promote and balance the objective of protecting government integrity and that of facilitating the recruitment and retention of personnel needed by the Hospital. The policy shall be implemented by prescribing essential standards of ethical conduct without creating unnecessary obstacles to entering public service.

 

9512.3It shall be a breach of ethical standards for any employee to participate directly or indirectly in a procurement when the employee knows that the employee or any member of the employee’s immediate family has a financial interest pertaining to the procurement.

 

9512.4When a Hospital employee knows that he or she has an actual or potential conflict of interest, or when the CO has determined that an actual conflict of interest exists, such employee shall be disqualified from the procurement involved. The employee may apply to the Executive Director for a waiver of the conflict of interest prohibition.

 

9512.5It shall be a breach of ethical standards for any person to offer, give, or agree to give any employee or former employee, or for any employee or former employee to solicit, demand, accept, or agree to accept from another person, a gratuity or an offer of employment in connection with any decision, approval, disapproval, recommendation, or preparation of any part of a procurement.

 

9512.6It shall be a breach of ethical standards for any payment, gratuity, or offer of employment to be made by or on behalf of a subcontractor under a contract to the prime contractor, or higher tier subcontractor, as an inducement for the award of a subcontract or order.

 

9512.7It shall be a breach of ethical standards for any employee, former employee or any other person knowingly to use confidential information for actual or anticipated personal gain.

 

9512.8No employee, officer, or Commission member shall serve on the board of directors or other governing body (whether or not compensated) of any contractor with whom the Hospital has a current contractual relationship if the individual’s responsibilities with the Hospital entail the letting or management of the contract.
