Section 24-2603. SCHEDULE OF FINES

    2603.1Any person found in violation of the Act, this chapter, or any condition of an Ultra-Hazardous Materials Transport Permit shall be subject to penalties in accordance with the following schedule:

     

    (a)First offense: Ten thousand dollars ($10,000);

     

    (b)Subsequent offenses: Twenty-five thousand dollars ($25,000).

     

    2603.2Each violation shall be treated separately. When the violation is a continuing one, each day of the violation constitutes a separate offense.

     

    2603.3The Director may temporarily suspend or revoke an Ultra-Hazardous Materials Transport Permit when it can be demonstrated that a carrier has violated the Act, this chapter, or any condition of an Ultra-Hazardous Materials Transport Permit.

     

    2603.4If any person fails to pay any penalty, costs, or interest due as the result of any violation of the Act, this chapter, or any condition of an Ultra-Hazardous Materials Transport Permit, the Director may use any method described in section 8(f) of the Litter Control Administration Act of 1985, effective March 6, 2002 (D.C. Law 14-78; D.C. Official Code § 8-807(f)) (2004 Supp.) to obtain payment.
