Section 25-B3505. ADMINISTRATIVE - EMBARGO ORDER, OFFICIAL TAGGING OR MARKING OF FOOD

    3505.1The Department shall affix an official tag, label, or other appropriate marking on the food or containers or otherwise conspicuously identify food subject to the embargo order.

     

    3505.2The official tag, label, or marking required in section 3505.1 shall:

     

    (a)Give notice that the food is or is suspected of being adulterated or misbranded;

     

    (b)Give notice that the food has been detained or embargoed for a period not to exceed five (5) business days; and

     

    (c)Contain a warning to all persons not to remove or dispose of the food, except as specified in section 3506.

     

    3505.3The tag or other method used to identify a food that is the subject of an embargo order shall include a summary of the provisions specified in section 3504 and shall be signed and dated by the Department.
