Section 25-C6439. PHYSICAL FACILITIES - EFFECTIVE BARRIERS, FENCES*

    6439.1All outdoor swimming pools and spa pools shall be surrounded by a minimum seventy-two inch (72 in.) high fence or other substantial barrier approved by the Department.

     

    6439.2The fence shall be continuous around the perimeter of the pool area that is not otherwise blocked or obstructed by adjacent buildings or structures and shall adjoin with itself or abut to the adjacent members.

     

    6439.3Access through the barrier or fence from dwelling units such as homes, apartments, motel rooms, and hotel rooms, shall be through self-closing, self-latching lockable gates of forty-eight inch (48 in.) minimal height from the floor with the latch located a minimum of fifty-four inches (54 in.) from the bottom of the gate or at least three inches (3 in.) below the top of the gate on the pool side.

     

    6439.4Doored access points from public rooms such as lobbies or club houses need not be through gates.

     

    6439.5Gates shall open outward away from the pool area.

     

    6439.6A latched, lockable gate shall be placed in the fence within ten feet (10 ft.) of the equipment area for service access.

     

    6439.7Screened pool enclosures shall be hardened on the bottom three feet (3 ft.)

     

    6439.8Fencing consideration shall be given to the U.S. Consumer Product Safety Commission (CPSC) Publication No. 362 Guidelines.

     

    6439.9Safety Covers that comply with ASTM Standard F1346 shall be retrofitted to comply with the swimming pool and spa drain cover entrapment protection standards of the ASME/ ANSI A112.19.8 performance standard as specified in section 6420.6.
