Section 25-C805. ADMINISTRATIVE ENFORCEMENT ACTION - CONDEMNATION ORDER, REMOVING THE OFFICIAL TAG OR MARKING

805.1No person shall remove Department posted tags, labels, or other appropriate markings except under the direction of the Department as specified in Subsection 805.2.
805.2The Department of Health shall issue a notice of release from a condemnation order and shall remove condemnation tags, labels, or other appropriate markings from equipment, chemicals, or other operational supplies if:
(a)The condemnation order is vacated; or
(b)The licensee notifies the Department that the equipment, chemicals, or other operational supplies have been modified to meet NSF/ANSI or ASME/ANSI standards and the requirements of this Regulation, and the Department has conducted a re-inspection.
