Section 25-D1402. INVESTIGATION AND CONTROL - RESTRICTION OR EXCLUSION OF LICENSEE, MANAGER, OR EMPLOYEE OR SUMMARY SUSPENSION OF LICENSE

    1402.1Based on the findings of an investigation related to a licensee, manager, employee or customer who is suspected of being infected or diseased, or a carrier of an infectious agent that causes a disease that is transmissible through bloodborne or skin pathogens, the Department may issue an order to the suspected licensee, manager, employee or instituting one (1) or more of the following control measures: 

     

    (a)Restricting the licensee, manager, or employee;

     

    (b)Excluding the licensee, manager, or employee; or

     

    (c)Closing the massage establishment or health spa facility by summarily suspending a license to operate in accordance with these regulations.
