Section 26-A3801. DELEGATION OF HEARING AUTHORITY

    3801.1The Commissioner may, in his or her discretion, delegate authority to conduct a hearing to a hearing officer. The Commissioner shall serve a notice of delegation on all parties and on the hearing officer.

     

    3801.2The designated hearing officer shall issue a proposed decision and order that includes proposed findings of fact and conclusions of law.

     

    3801.3The Commissioner may, at his or her discretion, rescind all or part of the authority delegated to the hearing officer. If only part of the delegation is rescinded, the Commissioner shall specify in the order of rescission the portions of the matter for which the delegation has been rescinded. The rescission order shall be effective on the date it is signed by the Commissioner, unless a different effective date is specified in the order.

     

    3801.4The final decision issued by the Commissioner or proposed decision issued by the designated hearing officer shall reflect the rescission of delegation, and a copy of the rescission order shall be included as part of the record.
