Section 27-4028. USE OF WARRANTIES

4028.1The contracting officer shall not include a warranty in a cost-reimbursement contract unless approved by the head of the contracting agency.

4028.2A warranty clause shall not limit the District's rights under an inspection clause in relation to latent defects, fraud, or gross mistakes that amount to fraud.

4028.3A warranty clause shall provide that the warranty applies notwithstanding inspection and acceptance, or other clauses or terms of the contract.

4028.4The Director shall prescribe procedures for the use of warranties in contracts.
