Chapter 29-54. STANDARDS FOR MANAGED CARE PRIMARY CARE PROVIDERS THAT ARE PAID ON A FEE-FOR-SERVICE BASIS FOR SERVICES RENDERED TO AFDC AND AFDC-RELATED MEDICAID RECIPIENTS |
Section 29-5408. AUDIT AND REPORTING REQUIREMENTS

5408.1Each fee-for-service primary care provider shall maintain adequate records and data to demonstrate service delivery and payment.
5408.2Upon the Department’s written request, the fee-for-service primary care provider shall assist the federal government or its agents, or the Department in verifying the service delivery and payment records and data.
5408.3Records shall be retained by the fee-for-service primary care for at least a five (5) year period.
5408.4If any litigation, claim, negotiation, audit, or other action involving the records described in this section is initiated before the expiration of the five (5) year period, the records shall be retained until completion of the action and final resolution of all issues that arise from the litigation, claim, negotiation, audit, or other action, including any appeal and the expiration of any right of appeal, or until the end of the five (5) year period, whichever is later.
