Section 29-5827. APPEALS

5827.1Denials of requests for waiver(s) under this chapter shall:

(a)Be in writing;

(b)State the reason for denial; and

(c)Explain the process of appealing the decision.

5827.2Denials may be appealed through the fair hearing process.

5827.3An applicant or recipient shall have ninety (90) days to file an appeal.

5827.4If an applicant or recipient appeals a decision within fifteen (15) days, the waiver request shall be considered pending for the duration of the appeal, pursuant to subsections 5823.3 and 5823.4.
