Section 29-5905. DENIAL OR DISMISSAL OF REQUEST FOR FAIR HEARING

5905.1CFSA may deny a request for a fair hearing, or a preliminary expedited review hearing, if:

(a)The sole issue raised by the appellant concerns the plain language of a District statute, regulation or policy; or

(b)The request is not filed with the designated individual within the time frames set forth in § 5903.4 or § 5903.6.

5905.2CFSA may dismiss a request for a fair hearing, or an expedited preliminary review hearing, if the appellant or his representative:

(a)Withdraws the request in writing;

(b)Dies; or

(c)Without good cause, does not appear at the expedited preliminary review hearing or the fair hearing.
