Chapter 29-59. FAIR HEARING PROCEDURES FOR THE CHILD AND FAMILY SERVICES AGENCY |
Section 29-5999. DEFINITIONS

5999.1The following terms and phrases shall have the meanings described:
"Appellant" - An applicant, recipient, person identified in a Child Protection Register report, or a licensee of a foster, youth residential facility, or independent living program who is appealing a CFSA decision, or a legal representative.
"Applicant" - A person who applies for a subsidy or to become a licensed foster parent, to operate a youth residential facility or to operate an independent living program.
"Business day" - Monday through Friday excluding legal holidays.
"CFSA" - The District of Columbia Child and Family Services Agency.
"Child Protection Register" - The confidential index of all reports of suspected child abuse or neglect established pursuant to The Prevention of Child Abuse and Neglect Act of 1977, effective September 23, 1977, D.C. Law 2-22, title II, § 201, or its equivalent in another jurisdiction.
"Court" - The District of Columbia Superior Court.
"Director" - The Director of the D.C. Child and Family Services Agency or his or her designee, or the administrative head of any successor agency.
"Emergency" - A situation that constitutes an immediate or serious and continuing danger to the health, safety or welfare of residents or staff.
"Emergency suspension or conversion" - The suspension or conversion of a license to operate a foster home, youth residential facility or independent living program on an emergency basis without prior notice or hearing.
"Hearing Examiner" - The individual appointed by the Director to conduct fair hearings and make final decisions under the regulations.
"Independent living program" - A program licensed pursuant to 29 DCMR Chapter 63.
"Licensing Record" - the files and records maintained by CFSA, other than information required by law to be kept confidential, that pertains to the decision regarding licensing.
"Licensed foster parent" - A person who is licensed as a foster parent in accordance with 29 DCMR Chapter 60.
"Party" - The appellant and CFSA through the Program Administrator or designee.
"Recipient" - A person who applies for and receives a subsidy from CFSA.
"Representative" - Any person, including a non attorney, authorized by an appellant in writing to represent the appellant in a fair hearing.
"Service" - The provision of a subsidy or any other child welfare service for which a fair hearing is permitted under this Chapter.
"Subsidy" - A monthly payment made to certain adoptive or permanent guardianship families to financially support care of a child who was placed in the permanent placement.
"Youth residential facility" - A facility licensed pursuant to 29 DCMR Chapter 62.
