Section 3-3706. INSTITUTION OF A CHARGE AND FORMAL HEARING

    3706.1Upon belief that sufficient evidence exists constituting an apparent violation of the Act and/or of Chapters 30-41 of this title, the Director shall institute a formal charge or complaint against the alleged violator pursuant to Chapter 4 of this title.

     

    3706.2The complaint shall include:

     

    (a) The basis for the Director’s jurisdiction over the alleged violation(s);

     

    (b) A recitation of the facts alleged to be violations of the Act and/or regulations;

     

    (c) Proposed sanctions; and

     

    (d) A prayer for relief.

     

    3706.3The Director shall present evidence of the violation to the Board in an adversarial and open hearing.
