Section 4-411. SERVICE OF WRITTEN COMMUNICATIONS

    411.1Parties shall serve copies of any written communication to the Commission or to the hearing examiner on all other parties.

     

    411.2The Commission and the hearing examiner shall serve copies of all written communications to any party on all other parties.

     

    411.3Service on any representative whose appearance has been duly noted pursuant to § 408.6 shall be considered to be service on the party represented by that representative.

     

    411.4Except as otherwise required by statute or this chapter, service shall be effected by first class mail, postage prepaid, or by personal delivery, to one of the following:

     

    (a)The addressee;

     

    (b)Any competent person who resides at the addressee’s abode, if delivery is made at that abode;

     

    (c)Any partner, if the addressee is a partnership; or

     

    (d)Any officer or officer’s secretary, if the addressee is a corporation.

     

    411.5Whenever a party has the right or duty to act or proceed within a prescribed period after the service of a notice or other paper upon the party and the paper or notice is served upon the party by mail, three (3) days shall be added to the prescribed period.
