Section 5-A2847. DAY AND RESIDENTIAL PROGRAM TUITION RATE ESTABLISHED BY THE DISTRICT

    2847.1Effective July 1, 2011, the maximum annual per student tuition rate to be paid by the District of Columbia to a nonpublic special education school or program shall be based on the funding established by the Uniform Per Student Funding Formula (UPSFF) for students with disabilities enrolled in a District of Columbia public school.

     

    2847.2The maximum per diem tuition rates for non-ESY school days shall be derived by dividing the maximum annual per student tuition rate by one hundred eighty (180). 

     

    2847.3If the District’s annual budget for the next fiscal year (beginning October 1) has not been approved by Congress by July 1, OSSE shall use the UPSFF rate set forth in the supplementary material (Budget Books) provided to Congress with the District’s Budget Request Act, until such time as the District’s annual budget has been approved by Congress. 

     

    2847.4 If the final version of the UPSFF enacted into law for a fiscal year differs from the UPSFF submitted to the U.S. Congress, OSSE shall reconcile payments consistent with the final UPSFF.  Within sixty (60) business days after the effective date of the final UPSFF, the amounts paid to a nonpublic special education school or program or related service provider shall be reconciled in the following manner:

     

    (a) A debit or a credit shall be posted to the account of each school, program, or provider as appropriate;

     

    (b) Cash reimbursement for a credit may be considered only in exceptional circumstances based upon a written justification from the nonpublic special education school or program or related service provider, and accepted by OSSE.
