    402.1The Executive Secretary to the Board of Education is authorized to establish and implement a system for the distribution to the public, upon request, copies of the following:

     

    (a)Transcripts, or portions of transcripts, of any of the following meetings of the Board of Education:

     

    (1)Regular monthly meetings;

     

    (2)Special meetings; and

     

    (3)Emergency meetings; and

     

    (b)The rules of the Board of Education.

     

    402.2The Executive Secretary is authorized to establish and provide for the collection of fees for copies of all or part of the Rules of the Board of Education and all or part of transcripts of meetings of the Board.

     

    402.3The fees established under § 402.2 shall not exceed the following amounts:

     

    (a)Transcripts: twenty cents (20¢) per page; and

     

    (b)Rules of the Board of Education: ten dollars ($10) per complete set of current rules.

     

    402.4All fees collected shall be used to defray the costs of preparing, compiling, and duplicating copies of the Board rules and transcripts.

     

    402.5Copies of the rules of the Board of Education shall be available without charge for public inspection in the offices of the Board of Education during normal business hours.

     

    402.6Copies of the transcripts of meetings of the Board of Education shall be available without charge for public inspection in the offices of the Board of Education during normal business hours.

     

    402.7The Executive Secretary is authorized to enter into agreements with other agencies of the government of the District of Columbia for the exchange of copies of rules and regulations without payment of fees.

     

    402.8In the absence of an agreement as indicated in § 402.7, requests for copies of Board rules or transcripts of meetings of the Board of Education shall be honored upon the payment of the established fee.

     

    402.9In no case shall a fee be charged to the Corporation Counsel for materials to be used in connection with litigation involving the Board of Education.
