Section 6-B1135. PREMIUM PAY - ADMINISTRATIVE CLOSING PAY/LEAVE

1135.1Administrative closing pay shall not be provided nor shall administrative closing leave be paid unless specifically authorized by this section.
1135.2An emergency employee who is required to perform non-overtime work within his or her forty-hour (40-hour) basic workweek during a period of early dismissal or government closing in accordance with Chapter 12 of these regulations shall be entitled, as determined by the agency head, to either administrative closing pay or administrative closing leave, but not both, for the hours actually worked.
1135.3Administrative closing pay shall consist of additional compensation provided on an hour-for-hour basis, equivalent to the employee’s rate of basic pay, as compensation for work actually performed during a designated emergency.
1135.4One-quarter (¼) of an hour shall be the smallest fraction of an hour used for crediting administrative closing pay; but, when such work is performed in other than the full fraction, odd minutes shall be rounded up or rounded down to the nearest full fraction (i.e., quarter) of an hour.
1135.5Administrative closing pay shall be in addition to other pay and shall not be considered basic pay for any purpose.
1135.6Administrative closing leave shall consist of additional time off earned on an hour-for-hour basis as compensation for work actually performed during a designated emergency.
1135.7One-quarter (¼) of an hour shall be the smallest fraction of an hour used for crediting administrative closing leave; but, when such work is performed in other than the full fraction, odd minutes shall be rounded up or rounded down to the nearest full fraction (i.e., quarter) of an hour.
1135.8Administrative closing leave shall be maintained in a separate account from other forms of leave, but shall be scheduled and granted in accordance with the provisions contained in Chapter 12 of these regulations for annual leave.
1135.9Administrative closing leave that is not used within twelve (12) months of being earned shall be forfeited.
1135.10Upon separation from employment, an employee shall be paid, at his or her rate of basic pay at the time of separation, for any unused administrative closing leave remaining to his or her credit.
