Section 8-A1607. FORMAL GRIEVANCE PROCEDURES: STEP 1

    1607.1If the grievance is not resolved to the satisfaction of the employee by the informal grievance settlement process, as set forth in §§1605 and 1606, the employee may follow the formal grievance procedures.

     

    1607.2An employee shall initiate the formal grievance process by submitting the grievance in writing to the same person to whom the informal grievance was presented, pursuant to §1605.

     

    1607.3An employee must file the formal written grievance within five (5) working days after receiving an oral answer to his or her informal grievance, or within five (5) working days of the date when an answer should have been received.

     

    1607.4The formal written grievance shall be referred to as a "Statement of Grievance." The Statement of Grievance shall contain sufficient detail to clearly identify and explain the facts and circumstances that are the basis of the grievance. The Statement of Grievance shall also specify the relief or solution to the conflict being sought by the employee.

     

    1607.5Within three (3) working days of the receipt of the Statement of Grievance, the supervisor or other official to whom the formal grievance is presented shall hold a conference with the employee for the purpose of attempting to resolve the grievance. The employee's representative or counsel, if any, may be present and participate in the STEP 1 conference.

     

    1607.6The supervisor or other official conducting the conference may have other persons present at the STEP 1 conference who are relevent to the resolution of the grievance.

     

    1607.7The supervisor or other official conducting the STEP 1 conference shall give to the employee a written answer to the grievance within five (5) working days of the conference.

     

    1607.8If the employee does not receive a written answer to the grievance within five (5) working days of the STEP 1 conference, the employee shall have the right to pursue the STEP 2 grievance procedures, except as provided in §1607.9.

     

    1607.9If the STEP 1 grievance conference is conducted by the Dean, the Dean shall have ten (10) days to render a written decision under §1607.7, and the written decision of the Dean shall be the final decision of the School of Law on the grievance.
