Section 8-A608. ACADEMIC DEFICIENCY

608.1A student who does not achieve a cumulative grade point average (CGPA) of at least 1.85 for required first-year courses, including required first-year courses taken during the first Summer semester, shall be separated from the School of Law for academic deficiency.
608.2A student whose cumulative grade point average (CGPA) is not at least 1.85 at the end of any semester after the student’s second semester of study at the School of Law (including a Summer semester) shall be separated from the School of Law for academic deficiency.
608.3After the Spring semester of the first year, a student whose cumulative grade point average (CGPA) remains below 2.0 for two (2) consecutive semesters shall be separated from the School of Law for academic deficiency. A Summer semester in which a student in the full-time program is registered for fewer than ten (10) credits shall not be deemed a “consecutive semester” when applying this rule.
608.4If a student receives a notice of separation for academic deficiency more than thirty (30) days after the first day of classes of the semester (due the effect of an Incomplete ("I") being changed to a low letter grade, late posting of grades, or any other reason), the student may do either of the following:
(a)Accept immediate separation; or
(b)Complete the coursework for the current semester.
608.5A student who accepts immediate separation for academic deficiency under §608.4(a) shall receive a full refund of the tuition already paid for that semester and for any tuition paid in advance for a subsequent semester.
608.6If a student elects to complete the current semester after notice of separation for academic deficiency under §608.4(b), the separation shall become effective at the beginning of the following semester, regardless of the grades or cumulative grade point average (CGPA) achieved during the current semester. The student will not receive a refund of tuition for the current semester, but will receive a refund of any tuition paid in advance for a subsequent semester.
608.7For purposes of academic deficiency, including academic probation under §616, a student's semester grade point average (SGPA) and cumulative grade point average (CGPA) shall be calculated solely on the basis of final grades. For purposes of this subsection, the final grade for any course lasting more than one (1) semester shall be the final grade received at the end of the entire course.
