Section 8-B1521. DISCIPLINE AND TERMINATION RIGHTS OF FACULTY MEMBERS

    1521.1The due process rights set forth in this section shall be accorded to a faculty member against whom disciplinary proceedings, including termination for cause, are brought.

     

    1521.2The faculty member shall have the right to be served with written notice of the basis for the proposed adverse action.

     

    1521.3The burden of proof that the disciplinary action or termination is for adequate cause shall rest with the University and shall be satisfied only by clear and convincing evidence.

     

    1521.4Adverse action proceedings shall not restrain the faculty member in exercise of personal liberty or suspend the faculty member from regular duties unless there exists clear indication of harm to the health and safety of the University community.

     

    1521.5The faculty member shall have the right to a hearing and judgment by faculty peers, and the faculty member shall have the right to representation of his or her own choosing.

     

    1521.6The faculty member shall have the right to confront and cross-examine all witnesses and to examine all relevant information.

     

    1521.7The University shall make full disclosure to the faculty member of all information relevant to the proceedings and, upon request and at cost, shall provide the faculty member with a complete record of the proceedings. The faculty member shall be provided the time necessary to prepare for the proceedings.
