Section 8-B3069. ALTERNATIVE DISPUTE RESOLUTION

    3069.1The CCO may use Alternative Dispute Resolution (ADR) procedures to increase the opportunity for inexpensive and expeditious resolution of issues that are in dispute. 

     

    3069.2The elements of ADR shall include:

     

    (a) Existence of an issue in dispute;

     

    (b) Both parties agree to participate in the ADR process;

     

    (c) Both parties agree to use alternative dispute procedures; and

     

    (d) Participation of high-level officials from both parties who have the authority to involve the issue in controversy.

     

    3069.3ADR procedures may be used at any time that the CCO has the authority to resolve the issue in dispute.

     

    3069.4If a claim has been submitted, ADR procedures may be applied to all or a portion of the claim. 

     

    3069.5An agreement to use ADR shall be in writing and shall specify a maximum award that may be used by the arbitrator.
