Section 8-B723. APPEAL OF ADVERSE RESIDENCY CLASSIFICATION

    723.1A student may appeal his or her classification as a non-resident student in accordance with the provisions of this section.

     

    723.2Within seven (7) days of notification of the adverse classification, the student shall file an appeal with the Registrar.

     

    723.3The Registrar shall issue a decision, which shall include the reasons for the decision, not later than fifteen (15) days after receipt of the appeal, excluding University holidays.

     

    723.4A student may appeal an adverse decision by the Registrar to the Vice President for Academic Affairs. The appeal shall be filed with the Vice President for Academic Affairs within seven (7) days after notification of the Registrar's decision.

     

    723.5The Vice President for Academic Affairs shall issue a decision on the appeal within thirty (30) days after receipt of the appeal.

     

    723.6A student may appeal an adverse decision by the Vice President for Academic Affairs to the President. The appeal shall be filed with the President within seven (7) days after notification of the decision of the Vice President for Academic Affairs.

     

    723.7The President shall issue a decision within thirty (30) days after receipt of the appeal. The decision of the President shall be the final administrative decision of the University.

     

    723.8During the pendency of the appeal process, the student shall be assessed the non-resident tuition rate.

     

    723.9If, pursuant to the appeal process set forth in this section, the student is determined to be a resident student, the official making that determination shall direct that a refund be issued to the student.
