    (Technical Correction to Zoning Commission Order No. 11-01)

    The Zoning Commission for the District of Columbia (Commission), pursuant to its authority under § 1 of the Zoning Act of 1938, approved June 20, 1938 (52 Stat. 797; D.C. Official Code § 6-641.01 (2008 Repl.)), and 11 DCMR § 3030 (Consent Calendar), hereby gives notice of the adoption of the following text amendment to § 2116.12 of Zoning Regulations of the District of Columbia (DCMR Title 11). 

     

    Subsection 2116.2 was recently added to the Zoning Regulations by Z.C. Order No. 11-01.  The new provision did not exempt Industrial Zones from its scope, which resulted in unintended adverse consequences that this technical correction rectifies.

     

    Because this action is technical in nature, no public hearing is required, pursuant to the Consent Calendar provisions set forth in 11 DCMR § 3030 and, for that same reason, no referral to the National Capital Planning Commission was required. No changes were made to the text amendment as published in a notice of proposed rulemaking in the D.C. Register on November 11, 2011, at 58 DCR 9649.  No comments were received in response to the notice of proposed rulemaking. The Commission took final action to adopt the amendments at a public meeting on October 27, 2011.  The final rulemaking is effective upon publication of this notice in the D.C. Register.

     

    Title 11 DCMR, Chapter 21, OFF-STREET PARKING REQUIREMENTS, § 2116, LOCATION OF PARKING SPACES, § 2116.12 is amended by inserting the phrase “in an Industrial Zone or” after the phrase “Except for parking” so that the provision reads as follows:

     

    2116.12           Except for parking in an Industrial Zone or accessory to a one-family dwelling, parking spaces provided within a structure shall be located at least twenty feet (20 ft.) from all lot lines that abut public streets, unless the ceilings of all parking levels are at or below the grade of the adjacent public sidewalk at all points along the building frontage.

     

    On October 27, 2011, upon the motion Chairman Hood, as seconded by Commissioner Turnbull, the Zoning Commission ADOPTED this Order at its special public meeting by a vote of 4-0-1 (Anthony J. Hood, Konrad W. Schlater, Peter G. May, and Michael G. Turnbull to adopt; Marcie I. Cohen, not present, not voting).
