    NOTICE OF FINAL RULEMAKING

     

    The Director of the Department of Motor Vehicles (Director), pursuant to the authority set forth in sections 1825 and 1826 of the Department of Motor Vehicles Establishment Act of 1998, effective March 26, 1999 (D.C. Law 12-175; D.C. Official Code §§ 50-904 and 50-905 (2009 Repl.); sections 6 and 7 of the District of Columbia Traffic Act of 1925, approved March 3, 1925 (43 Stat. 1121; D.C. Official Code §§ 50-2201.03 and 50-1401.01 (2009 Repl.); and Mayor’s Order 2007-168, dated July 23, 2007, hereby gives notice of the adoption of the following rulemaking that will amend chapter 1 (Issuance of Driver’s Licenses) of title 18 (Vehicles and Traffic) of the District of Columbia Municipal Regulations (DCMR). The rule clarifies the final rule published in the D.C. Register on September 16, 2011 at 58 DCR 8066 that increased the number of knowledge and road tests allowed to be taken in a twelve (12) month period for driver’s license applicants. 

     

    Notice of Proposed Rulemaking was published in the D.C. Register on December 16, 2011, at 58 DCR 10671. No comments were received and no substantive changes were made to the text of the proposed rule. The Department of Motor Vehicles adopted the rules as final on January 17, 2012.  The final rule will become effective upon publication in the D.C. Register.

     

    Section 104, EXAMINATION OF APPLICANTS FOR DRIVER’S LICENSES, of chapter 1, ISSUANCE OF DRIVER’S LICENSES, of title 18, VEHICLES AND TRAFFIC, of the DCMR is amended as follows:

     

    Subsection 104.10 is amended so that it is clear that if a person fails the sixth written knowledge or road examination, no further examination shall be given by the Department until a period of twelve (12) months has elapsed from the date of the first examination failed, so that the provision reads as follows:

     

    104.10            Applicants shall be limited to six (6) written knowledge tests and six (6) road tests within a twelve (12) month period, whether applying for a new license or renewal. If the applicant fails the sixth examination, no further examination shall be given by the Department until a period of twelve (12) months has elapsed from the date of the first examination failed.
