THIS CASE IS OF INTEREST TO ANC 8B
In a petition dated November 17, 2011, ANC 8B petitioned the Zoning Commission for the District of Columbia (“Commission”) for amendments to the Zoning Map to rezone Squares 5729 and 5729W from the R-3 Zone District to the R-5-A Zone District.
At its regular public meeting held December 12, 2011, the Commission setdown this case for a public hearing.
The R-3 Zone District is designed essentially for row dwellings, but may include areas within which row dwellings are mingled with one-family detached dwellings, one-family semi-detached dwellings, and groups of three or more row dwellings. Any use permitted in an R-1 or R-2 Zone District is also allowed in an R-3 Zone District, as well as row dwellings and certain types of community based residential facilities. The minimum lot area is 2,000 square feet for row dwellings, 3,000 square feet for semi-detached one-family dwellings, 9,000 square feet for public schools, and 4,000 square feet for all other structures. Buildings and structures are generally permitted a maximum height of 40 feet or four stories.
The R-5-A Zone District is a general Residence District designed to permit flexibility of design by permitting all types of urban residential development. In R-5-A Zone Districts, all new residential developments, except those comprising all one-family detached and semi-detached dwellings, must be reviewed by the Board of Zoning Adjustment as special exceptions. In the R‑5-A Zone District lot area is prescribed by the Board of Zoning Adjustment, except for Public Schools for which the R-3 standard applies. Floor area ratio is limited to a maximum of 0.9. The maximum permitted height is the same as for an R-3 Zone District.
Proposed amendments to the Zoning Map of the District of Columbia are authorized pursuant to the Zoning Act of June 20, 1938, (52 Stat. 797), as amended, D.C. Official Code § 6-641.01, et seq.
The public hearing on this case will be conducted as a rulemaking in accordance with the provisions of 11 DCMR § 3021. Pursuant to that section, the Commission will impose time limits on testimony presented to it at the public hearing.
