    FOR THE PURPOSE OF CONSIDERING THE FOLLOWING:

     

    CASE NO. 10-24 (Southeast Federal Center Overlay District Review @ Square 771, Lot 12 – Parcel D, 4th and M Streets, SE)

     

    THIS CASE IS OF INTEREST TO ANC 6D

     

    On October 4, 2010, the Office of Zoning received an application from FCW SEFC, LLC on behalf of the General Services Administration (the “Applicant”).  The Applicant is requesting review and approval of new development along M Street, S.E., pursuant to the Southeast Federal Center Overlay District provisions set forth in § 1803.8 of the Zoning Regulations (Title 11, DCMR).  In addition, the Applicant seeks review and approval for a building height of 110 feet as authorized in §1803.6 and special exception approval of roof structure flexibility as authorized in § 411.11.  The Applicant also seeks variance relief from the 4th Street setback requirement of §1803.10 in order to construct balconies that are located on the property but project into the setback area, and variance relief from §1803.11 in order to construct a driveway from M Street for loading access to the Project.  Subsection 1809.1 authorizes the Zoning Commission to hear and decide requests for additional zoning relief at the time it is undertaking a review required by § 1803.8.

     

    The property which is the subject of this application consists of approximately 101,376 square feet of land area (Square 771, Lot 12).  The property is bounded to the north by M Street, S.E, to the west by 4th Street, S.E., to the south by Tingey Street, S.E., and to the east by “Building 202”. The property is currently vacant and is zoned SEFC/CR, a district in which residential, retail, and office uses are permitted as a matter-of-right. 

     

    The Applicant proposes a mixed-use building containing residential apartments and retail uses.  The lower floors will be devoted primarily to retail uses and will include a grocery store. The upper stories will contain approximately 195 – 225 residential units, and 20% of these units will be set aside as affordable housing.  The floor area ratio ("FAR") of the property will be approximately 3.84 FAR (including approximately 1.09 FAR devoted to nonresidential uses).  The building height will measure approximately 110 feet.  The project will have a total of approximately 337 parking spaces in one level of below-grade and one level of above-ground parking, as well as loading berths and delivery spaces for the proposed uses.  The below grade parking will be accessed off 4th Street, and the remaining parking and loading will be accessed from a private service drive located along the eastern boundary of the property. 

     

    This public hearing will be conducted in accordance with the contested case provisions of the Zoning Regulations 11 DCMR, § 3022.

     

    Except for the affected ANC, any person who desires to participate as a party in this case must clearly demonstrate that the person’s interests would likely be more significantly, distinctly, or uniquely affected by the proposed zoning action than other persons in the general public.  Persons seeking party status shall file with the Commission, not less than 14 days prior to the date set for the hearing, a Form 140 – Party Status Application, a copy of which is attached hereto.  This form may also be obtained from the Office of Zoning at the address stated below or downloaded from the Office of Zoning’s website at: www.dcoz.dc.gov.

     

    Written statements, in lieu of personal appearances or oral presentations, may be submitted for inclusions in the record.

     

    If an affected Advisory Neighborhood Commission (ANC), pursuant to 11 DCMR 3012.5, intends to participate at the hearing, the ANC shall also submit the information cited in § 3012.5 (a) through (i).  The written report of the ANC shall be filed no later than seven (7) days before the date of the hearing.

     

    The following maximum time limits for oral testimony shall be adhered to and no time may be ceded:

     

                1.         Applicant and parties in support         60 minutes collectively

                2.         Parties in opposition                           60 minutes collectively

                3.         Organizations                                      5 minutes each

                4.         Individuals                                          3 minutes each

     

    Pursuant to § 3020.3, the Commission may increase or decrease the time allowed above, in which case, the presiding officer shall ensure reasonable balance in the allocation of time between proponents and opponents.
