    FOR THE PURPOSE OF CONSIDERING THE FOLLOWING: 

     

    Case No.  12-17 (Text Amendments to the Reed-Cooke Overlay District)

     

    THIS CASE IS OF INTEREST TO ANC 1C

     

    The law firm of Holland & Knight, LLP,  by petition dated September 6, 2012, petitioned the Zoning Commission for the District of Columbia (“Zoning Commission” or “Commission”) for text amendments to facilitate the preservation and renovation of the First Church of Christ Scientist for hotel use as proposed in the pending planned unit development application in Case No. 11-17. 

     

    The Office of Planning, by memorandum dated September 14, 2012, recommended that the text amendments be scheduled for public hearing.  At its regular public meeting held on September 24, 2012, the Zoning Commission set down this case for a public hearing. The petitioner filed no additional pre-hearing submission.

    The proposed amendments to the Zoning Regulations, Title 11 DCMR, as agreed to between the Applicant in Case No. 11-17 and the Reed-Cooke Neighborhood Association, are as follows:

     

    Chapter 14, REED-COOKE OVERLAY DISTRICT, is amended by adding new §§ 1401.4 and 1402.3, to read as follows:

     

    1401.4.   Notwithstanding § 1401.1, in order to preserve and adaptively reuse the First Church Christ Scientist building located on Lot 872 of Square 2560 (an objective specifically identified as part of the District of Columbia's Comprehensive Plan in Policy MC-1.2. 6), a hotel integrating the First Church Christ Scientist building shall be allowed on a new lot created by combining Lots 872, 875, and 127 of Square 2560 as a planned unit development, and within such hotel, restaurant and bar use shall be allowed, such restaurant and bar use to be located only within the First Church Christ Scientist building, provided that food and alcohol shall be permitted to be served in the enclosed pool, the meeting rooms, the guestrooms, and the rooftop area located in the addition to the First Church Christ Scientist building for so long as such addition and the First Church Christ Scientist building are being operated together as a hotel.

     

    1402.3.   Notwithstanding§ 1402.2, in order to preserve and adaptively reuse the First Church Christ Scientist building located on Lot 872 of Square 2560 (an objective specifically identified as part of the District of Columbia's Comprehensive Plan in Policy MC-1. 2. 6), a hotel integrating the First Church Christ Scientist building shall be allowed on a new lot created by combining Lots 872, 875, and 127 of Square 2560 as a planned unit development with a building height on former Lots 875 and 127 not to exceed 72 feet measured from Euclid Street, and an overall building density not to exceed 3.99 FAR.

     

    As an alternative, the Office of the Attorney General proposed, and the Commission will consider, the following language:

     

    1401.4   Notwithstanding § 1401.1, the Zoning Commission may approve a planned unit development that permits a hotel use integrating the First Church Christ Scientist building on a new lot created by combining Lots 872, 875, and 127 of Square 2560, and within such hotel, but only within the First Church Christ Scientist building, permit a restaurant and bar use; provided that the Zoning Commission may also permit food and alcohol to be served in the enclosed pool, the meeting rooms, the guestrooms, and the rooftop area located in the proposed addition to the First Church Christ Scientist building/or so long as such addition and the First Church Christ Scientist building are being operated together as a hotel.

     

    1402.3    Notwithstanding § 1402.2, the Zoning Commission, as part of a planned unit development permitting a hotel integrating the First Church Christ Scientist building on a new lot created by combining Lots 872, 875, and 127 of Square 2560, may permit a building height on former Lots 875 and 127 not to exceed 72 feet measured from Euclid Street, and an overall building density not to exceed 3.99 FAR.

     

    Proposed amendments to the Zoning Regulations of the District of Columbia are authorized pursuant to the Zoning Act of June 20, 1938, (52 Stat. 797), as amended, D.C. Official Code § 6-641.01, et seq.

     

    The public hearing on this case will be conducted as a rulemaking in accordance with the provisions of 11 DCMR § 3021.  Pursuant to that section, the Commission will impose time limits on testimony presented to it at the public hearing.
