    NOTICE OF FINAL RULEMAKING

     

    The Director of the Department of Motor Vehicles (Director), pursuant to the authority set forth in sections 1825 and 1826 of the Department of Motor Vehicles Establishment Act of 1998, effective March 26, 1999 (D.C. Law 12-175; D.C. Official Code §§ 50-904 and 50-905 (2001)), sections 3, 9  and 10 of the Uniform Classification and Commercial Driver’s License Act of 1990, effective September 20, 1990 (D.C. Law 8-161; D.C. Official Code §§ 50-402, 50-408,  and 50-409 (2001)), section 6 of the District of Columbia Traffic Act of 1925, approved March 3, 1925 (43 Stat. 1121; D.C. Official Code § 50-2201.03 (2001)), Mayor’s Order 91-161, dated October 15, 1991, and Mayor’s Order 2007-168, dated July 23, 2007, hereby gives notice of the  adoption of the following rulemaking that will amend  Chapter 13 (Classification and Issuance of Commercial Driver’s Licenses) of Title 18 (Vehicles and Traffic) of the District of Columbia Municipal Regulations (DCMR). The proposed rules increase the number of knowledge and skills tests allowed to be taken in a twelve (12) month period for commercial driver’s license applicants, and increase the fee to obtain a duplicate commercial driver’s license.

     

    Pursuant to section 10 of the Uniform Classification and Commercial Driver’s License Act of 1990, effective September 20, 1990 (D.C. Law 8-161; D.C. Official Code § 50-409 (2001)), the proposed rules were submitted to the Council of the District of Columbia (Council) for a forty-five (45)-day period of review (excluding weekends, holidays and days of Council recess). The forty-five (45)-day period of review expired on October 12, 2011 and the Council has taken no action. Therefore, the rules are deemed approved.

     

    Notice of Proposed Rulemaking was published on June 3, 2011, at 58 DCR 4840 that included a proposed fee of fifteen ($15) dollars to obtain a duplicate identification card. On July 8, 2011, Emergency Rulemaking was published at 58 DCR 5695 reflecting a fee change for a duplicate identification card to twenty ($20) dollars, rather than fifteen ($15) dollars to conform with the section 6001, Department of Motor Vehicles Fee Modification, of the Fiscal Year 2012 Budget Support Act of 2011 (D.C. Act 19-98; 58 DCR 6226 (July 29, 2011)). The Emergency Rulemaking went into effect on July 1, 2011.

     

    No comments were received and no substantive changes were made to the text of the proposed rule, except that the duplicate identification card fee has been deleted herein as a result of the enactment of the Fiscal Year 2012 Budget Support Act of 2011, effective September 14, 2011 (D.C. Law 19-21; 58 DCR 6226 (July 29, 2011)), which included the fee of twenty ($20) dollars for a duplicate identification card. The Department of Motor Vehicles adopted the rules as final on October 13, 2011.  The rulemaking will become effective upon publication in the D.C. Register.

     

    Title 18, VEHICLES AND TRAFFIC, of the DCMR is amended as follows:

     

    Chapter 13, CLASSIFICATION AND ISSUANCE OF COMMERCIAL DRIVER’S LICENSES, is amended as follows:

     

    Section 1315, COMMERCIAL DRIVER’S LICENSE KNOWLEDGE TEST, subsection 1315.5 is amended to increase the number of times that an applicant may take the applicable commercial driver’s license knowledge test from three (3) to six (6) times within a twelve (12) month period, so that the provision reads as follows:

     

    1315.5             An applicant may take the applicable commercial driver’s license knowledge test no more than six (6) times within a twelve (12) month period.

     

    Section 1316, COMMERCIAL DRIVER’S LICENSE SKILLS TEST, subsection 1316.5 is amended to increase the number of times that an applicant may take the commercial driver’s license skills test from three (3) to four (4) times within a twelve (12) month period, so that the provision reads as follows:

     

    1316.5             An applicant may take the commercial driver’s license skills test no more than four (4) times in a twelve (12) month period.

     

    Section 1326, FEES, subsection 1326.1 is amended to increase the fee for a duplicate commercial driver’s license from thirteen dollars ($13) to twenty dollars ($20) so that the provision reads as follows:

     

    1326.1             Every applicant for a commercial driver’s license shall pay a non-refundable fee, payable to the D.C. Treasurer, for the following commercial driver’s license transactions:
