    IN THE COUNCIL OF THE DISTRICT OF COLUMBIA

     

    October 2, 2012

     

    To declare the existence of an emergency, due to Congressional review, with respect to

    the need to amend Chapter 10 of Title 47 of the District of Columbia Official Code to exempt from taxation certain property owned or ground leased by Meridian Public Charter School, a nonprofit corporation, or by Meridian–Harrison QALICB, Inc., a nonprofit corporation.

     

    RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this resolution may be cited as the “Meridian Public Charter School-Harrison Campus Property Tax Exemption Congressional Review Emergency Declaration Resolution of 2012”.

     

    Sec. 2. (a) The Meridian Public Charter School is seeking an exemption from District real estate, recordation, and transfer taxes with respect to property located at 2120 13th Street, N.W., which formerly housed the Harrison School. 

                (b) The Meridian Public Charter School-Harrison Campus Property Tax Exemption Emergency Amendment Act of 2012, effective July 25, 2012 (D.C. Act 19-415; 59 DCR 9351), which granted an exemption from taxation for certain property owned or ground leased by Meridian Public Charter School, will expire on October 23, 2012.  The Meridian Public Charter School-Harrison Campus Property Tax Exemption Amendment Act of 2012, passed by the Council on 2nd reading on September 19, 2012, has not completed the 30-day Congressional review period required by section 602(c)(1) of the District of Columbia Home Rule Act, approved December 24, 1973(87 Stat.813; D.C. Official Code § 1-206.02(c)(1)).

                (c) Because the emergency law regarding this matter expires on October 23, 2012, and the permanent bill will not become effective until the end of 2012 or the beginning of 2013, it is important to enact this Congressional review emergency legislation to continue to grant an exemption from taxation for certain property owned or ground leased by Meridian Public Charter School.

     

    Sec. 3.  The Council of the District of Columbia determines that the circumstances enumerated in section 2 constitute emergency circumstances making it necessary that the Meridian Public Charter School-Harrison Campus Property Tax Exemption Congressional Review Emergency Act of 2012 be adopted after a single reading.

     

    Sec. 4.  This resolution shall take effect immediately.
