IN THE COUNCIL OF THE DISTRICT OF COLUMBIA

To declare the existence of an emergency with respect to the need to approve Modifications Nos. 8, 9, 10, 11, 12, 13, and 14 to Contract No. DCHC-2007-E-0001 to provide pharmacy benefit services to the District’s Medicaid eligible fee-for-service recipients and to authorize payment for the services received and to be received under that contract.
RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this resolution may be cited as the “Contract No. DCHC-2007-E-0001 Modification Approval and Payment Authorization Emergency Declaration Resolution of 2012”.
Sec. 2. (a) There exists an immediate need to approve Modifications Nos. 8, 9, 10, 11, 12, 13, and 14 to Contract No. DCHC-2007-E-0001 with Xerox State Healthcare, LLC., to provide pharmacy benefit services to the District’s Medicaid eligible fee-for-service recipients and to authorize payment for the services received and to be received under that contract.
(b) Modifications 8, 9, 10, 11, 12, and 13, exercised partial options of the second option year in the amount of $1,430,111.86 for the period from February 21, 2012, through September 30, 2012. By proposed Modification 14, the District will exercise the remainder of option year 2 from October 1, 2012, through February 20, 2013, for a total of $1,021,508.47. The total retroactive amount for option year 2 is $2,451,620.33.
(c) Council approval is necessary as this modification increases the contract to one of more than $1 million during a 12-month period.
(d) Council approval is necessary to allow the continuation of these vital services. Without this approval, Xerox State Healthcare, LLC, cannot be paid for services provided in excess of $1 million.
Sec. 3. The Council of the District of Columbia determines that the circumstances enumerated in section 2 constitute emergency circumstances making it necessary that Contract No. DCHC-2007-E-0001 Modificatios Approval and Payment Authorization Emergency Act of 2012 be adopted after a single reading.
Sec. 4. This resolution shall take effect immediately.
