    IN THE COUNCIL OF THE DISTRICT OF COLUMBIA

     

    October 2, 2012

     

     

    To declare the existence of an emergency with respect to the need to approve the Second Amendment to Lease Agreement for 450 H Street, N.W., between the District of Columbia government and BREFOF 450 H REO LLC, a Delaware limited liability company.

     

     

                RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this resolution may be cited as the “450 H Street, N.W., Second Amendment to Lease Agreement Emergency Declaration Resolution of 2012”.

     

                Sec. 2. (a)  There exists an immediate need to approve the Second Amendment to Lease Agreement for 450 H Street, N.W.

                (b)  The District occupies a portion of 450 H Street, N.W., (“Premises”) pursuant to a lease agreement (“Lease”) between the District and BREOF 450 H REO LLC, dated July 18, 2001.

                (c)  The Lease, as amended by the First Amendment to Lease Agreement, expired on June 30, 2012.

                (d)  The District’s Department of Youth Rehabilitation Services (“DYRS”) currently occupies the Premises and needs to remain in the Premises until the District completes DYRS’ new headquarters.

     

    Sec. 3.  The Council of the District of Columbia determines that the circumstances enumerated in section 2 constitute emergency circumstances making it necessary that the 450 H Street, N.W., Second Amendment to Lease Agreement Emergency Act of 2012 be adopted after a single reading.

     

    Sec.  4.  This resolution shall take effect immediately.
