IN THE COUNCIL OF THE DISTRICT OF COLUMBIA

To declare the existence of an emergency with respect to the need to approve Change Orders No. 005 through No. 011 to the construction management agreement for Janney Elementary School between the District of Columbia government and Winmar-Dustin Janney Elementary School Joint Venture Contract No. GM-09-M-0825-FM, and to authorize payment to Winmar-Dustin Janney Elementary School Joint Venture in the aggregate amount of $1,966,848.80 for goods and services received under Change Orders No. 005 and No. 011.

 

 

            RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this resolution may be cited as the “Change Orders No. 005 through No. 011 to Contract No. GM-09-M-0825-FM Approval and Payment Authorization Emergency Declaration Resolution of 2012”.

 

            Sec. 2. (a)  There exists an immediate need to approve Change Orders No. 005 through No. 011 to Contract No. GM-09-M-0825-FM for work performed to complete construction management, as well as additional scope work, at Janney Elementary School in the aggregate amount of $1,966,848.80 and to authorize payment for the goods and services received under Change Orders No. 005 through No. 011.

            (b)  Contract No. GM-09-M-0825-FM was submitted to and approved by the Council (CA18-0263 and CA18-0367).

            (c)  The additional scope work under Change Orders No. 005 through No. 011 to Contract No. GM-09-M-0825-FM with Winmar-Dustin Janney Elementary School Joint Venture increases the contract to one of more than $1 million.

            (d)  Council approval of these change orders and authorization of payment in the aggregate amount of $1,966,848.80 to Winmar-Dustin Janney Elementary School Joint Venture are necessary to compensate the contractor for work completed at Janney Elementary School.

Sec. 3.  The Council of the District of Columbia determines that the circumstances enumerated in section 2 constitute emergency circumstances making it necessary that the Change Orders No. 005 through No. 011 to Contract No. GM-09-M-0825-FM Approval and Payment Authorization Emergency Act of 2012 be adopted after a single reading.

 

Sec.  4.  This resolution shall take effect immediately.
