NOTICE OF EMERGENCY AND PROPOSED RULEMAKING

 

The Executive Director of the District of Columbia Lottery and Charitable Games Control Board, pursuant to the authority set forth in D.C. Official Code §§ 3-1306 and 3-1321 (2007 Repl.); District of Columbia Financial Responsibility and Management Assistance Authority Order issued September 21, 1996; and Office of the Chief Financial Officer Financial Management Control Order No. 96-22 issued November 18, 1996, hereby gives notice of the adoption of amendments to chapters 6 and 9 of title 30 of the District of Columbia Municipal Regulations (DCMR) on an emergency basis.

 

The Lottery Winnings Redemption Act of 2011, effective September 14, 2011 (D.C. Law 19-21; 58 DCR 6226 (July 29, 2011) (to be codified at D.C. Official Code § 3-1318) amended the claim period for lottery prizes.  These amendments are necessary to bring title 30 of the DCMR into conformance with the changes in District law made by the Lottery Winning Redemption Act of 2011. It is anticipated that these emergency regulations will generate additional funds for the District of Columbia.

 

This emergency rulemaking was adopted on October 1, 2011, and became effective on that date. The Executive Director also gives notice of her intent to take final rulemaking action to adopt these amendments in no less than thirty (30) days from the date of publication of this notice in the D.C. Register.

 

These emergency rules will expire on January 28, 2012; one hundred twenty (120) days from the date of adoption, or upon publication of a Notice of Final Rulemaking in the D.C. Register, whichever occurs first.

 

 

Chapter 6, Claims and Prize Payments, of title 30, Lottery and Charitable Games, of the DCMR is amended as follows:

 

Section 600, Processing of Claims, subsection 600.4 is amended to read as follows:

 

600.4               A prize shall be claimed within one hundred eighty (180) days after the drawing in which the prize was won commencing with the day following the drawing, unless a shorter period of time has been authorized by the Executive Director for that particular game.

 

 

Chapter 9, Description of On-line Games, of title 30, Lottery and Charitable Games, of the DCMR is amended as follows:

 

Section 950, DC Fast Play Ticket Validation Requirements, subsection 950.6 is amended as follows:

 

 

950.6               DC Fast Play prizes claims must be claimed within one hundred eighty (180) days of the date that appears on the DC Fast Play game ticket.

 

 

All persons desiring to comment on the subject matter of this emergency and proposed rulemaking should file comments in writing not later than thirty (30) days from the date of publication of this notice in the D.C.
