    IN THE COUNCIL OF THE DISTRICT OF COLUMBIA

    To declare the existence of an emergency with respect to the need to approve a modification to Contract No. DCHC-2008-D-5052 to provide services to the District, and to authorize payment for the services received and to be received under that contract.

     

    RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this resolution may be cited as the “Modification to Contract No. DCHC-2008-D-5052 Approval and Payment Authorization Emergency Declaration Resolution of 2012”.

     

    Sec. 2. (a)  There exists a need to approve Modification No. 23 to Contract No.  DCHC-2008-D-5052 with DC Chartered Health Plan, Inc., to provide healthcare services to District of Columbia residents in Medicaid managed care and to authorize payment for the services received and to be received under that contract.

    (b)  On October 1, 2012, by Modification No. 23, the Office of Contracting and Procurement (“OCP”), on behalf of the Department of Department of Health Care Finance, exercised the remainder of option year 4 of Contract No. DCHC-2008-D-5052 services for the period from October 1, 2012, through April 30, 2013, in the amount of $340,940,705.

    (c)  Council approval is necessary as this modification increases the agreement to one of more than $1 million during a 12-month period.

     (d)  Council approval is necessary to allow the continuation of these vital services.  Without this approval, DC Chartered Health Plan, Inc., cannot be paid for services provided in excess of $1 million for the contract period October 1, 2012, through

    April 30, 2013.

     

    Sec. 3.  The Council of the District of Columbia determines that the circumstances enumerated in section 2 constitute emergency circumstances making it necessary that the Modification to Contract No. DCHC-2008-D-5052 Approval and Payment Authorization Emergency Act of 2012 be adopted after a single reading.

     

    Sec. 4.  This resolution shall take effect immediately.
